Welcome to Gift Live ("the App", "we", "us", "our"). By downloading, installing, accessing or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the App.
2. Eligibility
You must be at least the minimum age required in your jurisdiction (and never younger than 16 years old) to create an account and use the App. By using the App you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms.
3. Your Account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information and keep it up to date.
- We may suspend or terminate accounts that violate these Terms or applicable law.
4. Acceptable Use
You agree not to:
- Post or stream content that is illegal, hateful, harassing, violent, sexually explicit, or that infringes the rights of others.
- Impersonate any person or misrepresent your affiliation with anyone.
- Use the App to spam, scam, distribute malware, or engage in fraud.
- Attempt to reverse engineer, disrupt, or gain unauthorised access to the App or its systems.
- Record, redistribute, or misuse other users' content without permission.
5. Virtual Items, Coins & Diamonds
The App may allow you to purchase or earn virtual currencies (such as Coins, Diamonds and Points) and virtual gifts. Virtual items have no monetary value, are non-transferable outside the App, and are non-refundable except where required by law. We may manage, regulate, modify or remove virtual items at our discretion.
6. User-Generated Content
You retain ownership of the content you create. By posting or streaming content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content within the App for the purpose of operating and promoting the service. You are solely responsible for the content you publish.
7. Live Streaming & Video Calls
Live streams and calls may be recorded or moderated for safety and quality purposes. You must comply with all community guidelines during broadcasts. We may remove or restrict any stream that violates these Terms.
8. Payments & Withdrawals
Where in-app purchases or creator withdrawals are available, they are subject to the policies of the applicable platform (such as Google Play or the Apple App Store) and the payout methods we support. Fees, minimum thresholds and payout timings may apply.
9. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms or if we are required to do so by law. You may stop using the App and delete your account at any time.
10. Disclaimers
The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or profits, arising out of or related to your use of the App.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
